Commercial litigation finance is accelerating rapidly within the U.S. legal market.  With more than $10 billion in capital now invested in U.S. commercial litigation and a majority of law firms expecting to use litigation finance in the near-term, it has become essential for sophisticated lawyers to understand the salient features of litigation finance.  Litigation finance is an accessible and attractive tool that can allow lawyers to compete effectively for more business, while simultaneously providing resource-constrained clients with alternatives to the hourly rate structure.  Yet, lawyers must remain vigilantly informed about the key ethical considerations implicit in funded litigation.

Jeffrey Robinson is a shareholder with Ashburn & Mason P.C. and is an accomplished trial lawyer. His practice focuses on complex commercial litigation, white collar criminal defense, anti-trust, employment and regulatory investigations, and trusts and estates litigation. He regularly appears in both federal and state court, agency proceedings, and arbitrations, and has secured favorable jury verdicts for clients in commercial contract and wrongful death actions. Jeffrey frequently represents clients in government procurement matters involving bid protests, contract claims, and related procurement disputes. He also has significant experience counseling clients in defamation and related First Amendment cases.

Prior to joining Ashburn & Mason, Jeffrey worked as an Assistant Public Defender, where he tried approximately forty jury trials and achieved numerous acquittals in complex felony criminal cases. He served as a supervisor in the Anchorage Public Defender Office’s felony trial unit, where he trained both felony and misdemeanor lawyers in trial procedure. Prior to moving to Alaska, Jeffrey represented clients in civil litigation matters and criminal defense cases in Rhode Island.

Andrew Woltman is Managing Director and Co-Founder of Statera Capital and is responsible for investment sourcing, selection and management, fund operations, and investor relations. Andy also serves as Statera’s General Counsel and on Statera’s Investment Committee.

Andy is an experienced commercial litigator who has represented individuals and businesses in a wide range of complex commercial disputes. Andy joined Statera from McGuireWoods LLP, an AmLaw top 25 U.S. law firm by size with 1,000 attorneys practicing in 25 offices worldwide. As a partner in the firm’s commercial litigation practice, Andy represented commercial entities as plaintiffs and defendants in federal and state courts and arbitrations throughout the country.

Andy has widespread experience in the financial services, food and beverage, healthcare, supply chain, real estate, oil & gas, manufacturing, and telecommunications industries. He has represented clients in varied complex commercial and business disputes, including contract, tort, fraud, shareholder derivative, antitrust, consumer protection, employment, constitutional, and RICO related litigation.

Andy received his B.S. from Boston College and J.D. from the University of Notre Dame Law School.

Rebecca Berrebi, Founder and CEO of Avenue 33, has worked in the business of litigation finance since 2016. Rebecca is a focused, commercially-minded problem-solver who understands today’s legal landscape and the financial realities of the dispute funding market. She has deep contacts and vast experience navigating legal, regulatory, enforcement, tax, capital markets and business concerns when structuring transactions and formulating strategies, leading to increased efficiency, cash savings and beneficial outcomes.

Most recently, Rebecca was the Head of Corporate Affairs at a leading litigation/arbitration fund manager with over $2 billion AUM, overseeing dozens of actual and potential cross-border, complex litigation and arbitration finance transactions from inception, through investment management, until finalization. Rebecca has also served on several boards and committees of companies undergoing claims, including as the Co-Chair of the Board of Directors of Eco Oro Minerals Corp. (CSE: EOM). In addition to her litigation finance experience, Rebecca has also worked in communications and politics, and she has practiced law. She started her career after graduating from Duke University in the political affairs and public relations industry working at Edelman and a national political campaign. After attending law school at the Benjamin N. Cardozo School of Law, she practiced as a private equity M&A lawyer for several years at Kirkland & Ellis LLC before serving briefly as a consultant in the legal group of a global private equity fund.

Rebecca combines her transactional legal background, business acumen and communications capabilities, as well as her general industry experience and contacts, to advise all types of stakeholders in the dispute finance industry on strategy.

Lucian T. Pera is a partner with the Memphis, Tennessee, office of Adams and Reese LLP. His practice includes civil trial work, including commercial litigation and media law, and he counsels and represents lawyers, law firms, and others on questions of legal ethics and the professional responsibility of lawyers. A Memphis native, he is a graduate of Princeton University and Vanderbilt University School of Law and served as a law clerk for U.S. Court of Appeals for the Sixth Circuit Harry W. Wellford. Pera joined Adams and Reese in 2006 to help open the firm’s Memphis office, after practicing law for 20 years with Armstrong Allen, PLLC.

Pera has served as president of the Association of Professional Responsibility Lawyers (APRL), the national membership organization of lawyers who work in the legal ethics arena. He has chaired and served as a member of the editorial board of the ABA/BNA Lawyers’ Manual on Professional Conduct. He has chaired ethics committees for the ABA Section of Business Law and the Media Law Resource Center Defense Counsel Section. He recently completed a three-year term as chair of the governing board of the ABA Center for Professional Responsibility. He currently serves as President of the Tennessee Coalition for Open Government.

He is a member of the American Law Institute, the American Bar Foundation, and is recognized in The Best Lawyers in America in the areas of First Amendment Law, Ethics and Professional Responsibility Law, Commercial Litigation, Health Care Law, and Legal Malpractice Law.

Pera is a former American Bar Association Treasurer and has served on the ABA Board of Governors and Executive Committee. With the exception of three years in the late 1990s, he has been a member of the ABA House of Delegates since 1991. He is also a past President of the Tennessee Bar Association
